This bill upgrades an assault committed on any uniformed crossing guard, parking attendant, or uniformed employee of a municipal parking authority, while clearly identifiable as being engaged in the performance of the person's duties or because of the person's status as a crossing guard, parking attendant or employee of a municipal parking authority, from a simple assault to an aggravated assault. In this situation, the aggravated assault is graded as a crime of the fourth degree, unless the victim suffers bodily injury, in which case, it is a crime of the third degree. A fourth degree crime is punishable by up to 18 months imprisonment, a fine of up to $10,000, or both. A third degree crime is punishable by a term of imprisonment of three to five years, a fine of up to $15,000, or both.
