Bill Summary

This bill authorizes certain fire police units to appoint fire police officers, and permits a notary public to administer an oath to a fire police officer. Currently, a volunteer fire company may appoint a member of the company as a fire police officer. Under the provisions of this bill, a fire police unit that is incorporated, has filed appropriate tax forms, insures all members, and has a designated station number may appoint a person who is not a member of the company as a fire police officer if the person is of good health and good moral character, and has not been convicted of a crime involving moral turpitude. An officer appointed by a unit will comply with the same requirements and will have the same duties as officers appointed by a volunteer fire company. Current law requires the municipal clerk to administer the oath to volunteer firefighters who perform police duties. Under provisions of this bill, a notary public also may administer an officer's oath.

AI Summary

This bill authorizes certain fire police units to appoint fire police officers who are not members of a volunteer fire company, as long as the unit is incorporated, has filed appropriate tax forms, insures all members, and has a designated station number. The bill also allows a notary public to administer the oath of office to fire police officers, in addition to the municipal clerk. Currently, only volunteer fire companies can appoint fire police officers from among their own members to perform certain police duties at fires and fire drills. This bill expands the pool of potential fire police officers by allowing non-members to be appointed, as long as they meet certain criteria, and provides an additional option for administering the required oath of office.
