This bill establishes assault of a retail worker as aggravated assault. Under current law, an assault committed against certain persons is upgraded to aggravated assault. This bill adds an employee of a retail mercantile establishment to the list of these enumerated persons. The bill defines "employee of a retail mercantile establishment" as any person engaged in the sale, display, or offering for sale of consumer commodities and who is employed by any place of business where merchandise is displayed, held, stored, or sold or offered at retail to members of the consuming public. Aggravated assault of a retail worker would become a crime of the third degree if the victim suffers bodily injury; otherwise it would be a crime of a fourth degree. A crime of the third degree is punishable by three to five years imprisonment, a fine of up to $15,000, or both. A crime of the fourth degree is punishable by up to 18 months imprisonment, up to a $10,000 fine, or both.
