This bill regulates pharmaceutical services in nursing homes by establishing new requirements for staffing and oversight. The legislation defines key terms such as "consultant pharmacist" (a licensed pharmacist meeting specific qualifications) and "long-term care facility" (specifically nursing homes licensed under existing state law). Each nursing home will now be required to have both a consultant pharmacist and either a provider pharmacist or an in-house pharmacy director, who must be a New Jersey licensed pharmacist complying with federal and state regulations. The bill mandates the creation of an interdisciplinary pharmacy and therapeutics committee that meets quarterly and includes representatives from administration, nursing staff, and the facility's consultant pharmacist. Importantly, the consultant pharmacist must be independent and have no affiliation with the facility's pharmaceutical services director or pharmacy provider to prevent conflicts of interest. Additionally, facilities storing emergency controlled substances must maintain current DEA and controlled substance registrations. The New Jersey Commissioner of Health, in consultation with the State Board of Pharmacy, is tasked with developing specific implementation rules and regulations, and the bill will take effect immediately upon passage.
