Bill Summary

This bill provides that, in general, health care facilities and health care professionals will be required provide the parent or guardian of an unemancipated patient who is younger than 18 years of age access to the patient's medical records without the need for the patient to authorize the parent or guardian to access the records. This right of access will not apply in certain limited situations under current law where minor patients are authorized to consent to treatment and a parent's access to the patient's medical records may be restricted, including when: a minor appears to have been sexually assaulted and the treating practitioner determines it is not in the minor's best interests to notify the parent or guardian; a minor seeks treatment for a substance use disorder; or a minor over 16 years of age seeks temporary outpatient behavioral health treatment for mental illness or an emotional disorder.

AI Summary

This bill provides that, in general, health care facilities and health care professionals must give the parent or guardian of an unemancipated patient under 18 access to the patient's medical records, without the need for the patient to authorize such access. However, this right of access does not apply in certain limited situations, such as when a minor appears to have been sexually assaulted, seeks treatment for a substance use disorder, or seeks temporary outpatient behavioral health treatment for mental illness or an emotional disorder. The bill also requires the Commissioner of Health and the Director of the Division of Consumer Affairs to promulgate rules and regulations to implement the provisions of the bill.
