This bill amends existing West Virginia law to provide parents and legal guardians access to the medical records of their minor children, without requiring any release, authorization, or permission from the minor child as a prerequisite. The bill specifies that parents may not be denied access to their minor child's health records unless otherwise ordered by a court or if the child has graduated high school, is emancipated, or is married. The bill also retains provisions from the existing law that require healthcare providers to furnish copies of patient records upon written request, within 30 days, in either paper or electronic format.
