This bill: Clarifies the definitions of Class I, II, and III wetlands, with Class I wetlands being those that are highly disturbed or have minimal habitat and hydrologic function, Class II wetlands being those that have moderate habitat or hydrologic function, and Class III wetlands being those that are minimally disturbed and support rare or ecologically important habitats. The bill also eliminates certain wetland rulemaking requirements and provides that certain wetland activities, such as the maintenance of field tiles, require state authorization. The bill clarifies the compensatory mitigation that must be offered to offset wetland impacts, including allowing the use of exempt isolated wetlands for mitigation and providing credit for preserving certain wetlands. The bill also makes conforming changes and technical corrections.
