This bill prohibits the release of booking photographs (mugshots) of arrested individuals by the Division of Corrections and Rehabilitation, except in certain limited circumstances, such as when the individual is a fugitive, an imminent threat to public safety, or has been convicted or pled guilty. The bill also requires websites that publish these mugshots for a fee to remove them within 7 days if the individual was not prosecuted or was acquitted, and imposes civil liability on such websites if they fail to do so. Additionally, the bill provides that law enforcement agencies and the Division of Corrections and Rehabilitation are not liable for mistaken or inadvertent release of mugshots.
