This bill, known as the "Vermont Defend the Guard Act," proposes to require the Governor to review every order to place a unit of the Vermont National Guard in federal active duty status for military conflict. The Governor must determine whether the order was issued in conformance with the U.S. Constitution, which allows Congress to call forth the militia to execute the laws of the union, suppress insurrections, and repel invasions. The bill also authorizes the Attorney General to take legal action to prevent the deployment of the Vermont National Guard if the Governor determines the order is unconstitutional. The bill will take effect on July 1, 2024.
