This bill amends existing Idaho law to establish requirements regarding the vacation of public rights-of-way that provide access to state or federal public lands or waters. The key provisions are: 1. Commissioners must accept evidence that a highway or public right-of-way proposed for vacation furnishes public access to state or federal public lands or waters. 2. No highway or public right-of-way that provides public access to state or federal public lands or waters can be vacated unless an equivalent or better replacement right-of-way is provided to maintain public access. 3. The replacement right-of-way must be of the same kind and substantially the same length, width, and quality as the vacated access, and may be privately maintained but must contain a perpetual, unfettered public right-of-way. 4. The bill also makes some technical corrections and declares an emergency, with the act taking effect on July 1, 2024.
