This bill prohibits persistent aerial surveillance by any state or local unit, agency, or political subdivision to gather evidence or information in a criminal investigation, except under certain limited circumstances. The bill defines "persistent aerial surveillance" as the use of aircraft to record video or a series of images that, when viewed together, depict a person's actions over time. The exceptions to the prohibition include when a valid search warrant is obtained, when executing an arrest warrant, during fresh pursuit of a suspect, to assist in an active search and rescue operation, to locate an escaped prisoner, to prevent imminent serious bodily harm or destruction of evidence, or when the U.S. Secretary of Homeland Security determines that there is a high risk of a terrorist attack and that persistent aerial surveillance is necessary to counter such a risk.
