This bill adds a new section to Idaho law to establish provisions regarding parental rights during certain child protection investigations. The key provisions are: (1) the Department of Health and Welfare must notify parents, guardians, or persons with legal custody of a child that they have the right to refuse to answer questions, obtain an attorney at their own expense, refuse entry to their home or property, and refuse questioning of their children unless authorized by a court order; (2) this notification must be provided in writing at the time of or within 72 hours of the first direct, in-person contact; (3) parents, guardians, or legal custodians may expressly assert these rights; and (4) failure to provide the notification does not affect the Department's ability to conduct the investigation or carry out its duties. The bill also declares an emergency and sets an effective date of July 1, 2024.
