This bill establishes a cause of action against public libraries, library boards, and their members, officers, trustees, librarians, employees, and agents for furnishing or allowing minors access to pornographic materials. The bill defines "pornographic materials to a minor" as any written, printed, or visual material that appeals to the prurient interests of minors, depicts nudity or sexual conduct in a patently offensive way, and lacks serious value for minors. The bill allows for damages of at least $25,000 per occurrence, up to a maximum of $100,000 for all claims arising from a single occurrence, as well as attorney's fees and court costs for a prevailing plaintiff.
