This bill creates new sections in the Kentucky Revised Statutes (KRS) Chapter 217 to regulate the sale and manufacture of kratom, a plant-based substance. Specifically, the bill: 1. Defines key terms, such as "kratom," "kratom extract," "kratom processor," "kratom product," and "kratom retailer." 2. Prohibits the sale of kratom products to individuals under 21 years of age and sets safety standards for kratom products, including limits on certain chemical compounds and prohibitions on adulteration. 3. Requires labeling of kratom products to provide information on ingredients, chemical composition, serving size, and safety disclaimers. 4. Authorizes the Department for Public Health to promulgate administrative regulations to implement the law. 5. Establishes civil penalties of up to $500 for a first offense and $1,000 for subsequent offenses for violations of the law. 6. Provides that if the federal government regulates kratom, those federal regulations will supersede and take precedence over the provisions of this bill.
