This bill establishes parental requirements regarding gender reassignment surgery or gender altering medications for minor children. The key provisions of the bill are: 1. All temporary parenting orders must contain language that prohibits a custodial parent from exposing the child to any medical practices prohibited by West Virginia law (§30-3-20) without the express written consent of the non-custodial parent, unless the court finds that the required permission is not in the best interest of the child. 2. All final parenting orders or final divorce orders that contain provisions relating to allocation of significant decision-making responsibility must contain similar language prohibiting the custodial parent from exposing the child to the prohibited medical practices without the non-custodial parent's consent, unless the court finds it is not in the child's best interest. 3. The definition of an "abused child" is expanded to include a child whose parent, guardian, or custodian knowingly transports or allows the transport of the child to an out-of-state healthcare facility for the purpose of allowing any medical act upon the child that is expressly prohibited by West Virginia law (§30-3-20).
