This bill allows a court to authorize a defendant's direct transfer from jail to inpatient or residential substance use disorder treatment. The key provisions include: (1) the court can change the release condition to a personal recognizance release with non-monetary conditions if the defendant has an offer of admission to a treatment facility and a trusted individual is available to escort the defendant directly from jail to the treatment facility; (2) the court or defense must notify the recovery navigator program when such an order is entered; (3) the defendant can bring a motion for pretrial release at any time they can satisfy the conditions, and the court must stay the criminal proceedings and order the release; (4) the jail must release the defendant only to the custody of the trusted individual at the time indicated on the court order; and (5) the treatment program must notify the court when the defendant is admitted and discharged, and the prosecutor can make a motion to lift the stay upon discharge.
