This bill establishes the offense of possession of an open alcoholic beverage container in a motor vehicle. It defines an "open alcoholic beverage container" as any bottle, can, or other receptacle that contains any amount of alcoholic beverage and is either open or has a broken seal, or the contents of which are partially removed. The "passenger area" is defined as the area designed to seat the driver and passengers while the vehicle is in operation, excluding any locked glove compartment or, in a passenger car not equipped with a trunk, any area behind the rearmost upright seat. The offense is an infraction and will not be reflected on any records maintained by the Department of Revenue. The provisions do not apply to passengers in the passenger area of a motor vehicle designed, maintained, or used primarily for the transportation of persons for compensation or in the living quarters of a motor home or house trailer.
