This bill amends Idaho law to add a new section called the "Freedom From AI-Rigged (FAIR) Elections Act". The key provisions of this bill are: 1. It defines "synthetic media" as images, audio, or videos that have been intentionally manipulated using technology to create a realistic but false depiction of an individual's appearance, speech, or conduct. 2. It allows a candidate whose appearance, action, or speech is altered through the use of synthetic media in an electioneering communication to seek injunctive or other equitable relief to prohibit the publication of such synthetic media. 3. It allows a candidate to bring an action for damages against the sponsor of the electioneering communication containing the synthetic media, and the court may award the prevailing party reasonable attorney's fees and costs. 4. It provides an affirmative defense if the electioneering communication containing the synthetic media includes a prominent disclosure stating "This (image/video/audio) has been manipulated". 5. It encourages courts to determine matters related to this law expeditiously, and it limits the liability of certain media platforms that disseminate the electioneering communication, with some exceptions.
