This bill amends Tennessee Code Annotated, Title 20, Title 25, and Title 26 to require plaintiffs in consumer debt actions filed in general sessions courts to include certain information with the civil warrant or other leading process, such as a statement that the debt claim has been transferred or assigned, the date of the transfer or assignment, the names of any prior holders of the debt starting from the point of charge-off, and the name or description of the original creditor. Additionally, the bill requires plaintiffs to present documentation to the court demonstrating their authority to collect the debt and evidence of the existence of the consumer debt, such as a signed agreement, a record of purchase or payment, or another record demonstrating the debt was incurred, prior to the award of a default judgment. These requirements do not apply to plaintiffs who are the original creditor on the consumer debt or listed as a lienholder on the property securing the debt.
