This bill amends Tennessee Code Annotated, Title 35, to update the requirements for public notice of a foreclosure sale of real property. The key provisions are: 1. Requires public notice to be posted on the Secretary of State's website for a minimum of 20 continuous days, in addition to being published at least once in a newspaper in the county where the sale is to be made. 2. Provides that if a newspaper is not published in the county where the land is to be sold, the newspaper publication requirement is waived, and public notice must still be posted on the Secretary of State's website. 3. Allows for the postponement or adjournment of a foreclosure sale, as long as certain requirements are met, such as posting the new date, time, and location on the Secretary of State's website. 4. Updates the requirements for the content of the public notice, including the names of the foreclosing party, property owner, and interested parties. 5. Provides that if the printer will not publish the public notice at a rate not more than its regular classified advertising rate, the newspaper publication requirement is waived, and public notice must still be posted on the Secretary of State's website. The bill takes effect on January 1, 2025.
