This bill creates a new criminal offense of recklessly threatening to commit an act of mass violence, which is defined as an act that could lead to the serious injury or death of four or more persons. The offense is a Class E felony, but it becomes a Class D felony if the threat involves a school, house of worship, government property, a live performance or event, the defendant has a prior conviction for a similar offense, or the defendant has taken a substantial step toward carrying out the threat. The bill also requires the defendant to undergo a behavioral risk assessment and potential mental health evaluation before being released on bail, and allows the court to order the defendant to pay restitution for any disruption caused by the threat.
