This bill, the DEFIANCE Act of 2024 or the Disrupt Explicit Forged Images and Non-Consensual Edits Act of 2024, aims to improve the rights of individuals affected by non-consensual activities involving intimate digital forgeries, often called "deepfakes." The bill amends existing law to define "digital forgeries" as synthetic images and videos that appear realistic and depict an identifiable individual engaging in sexually explicit conduct without their consent. The bill allows individuals who are the subject of non-consensual digital forgeries to bring civil actions against those who produced, disclosed, or solicited the forgeries, and provides for damages, injunctive relief, and other remedies. The bill also preserves the ability of states and tribes to adopt and enforce their own laws governing the disclosure of intimate images or non-consensual digital forgeries, as long as they are at least as protective of victims' rights as the federal law.
