This bill amends existing law in Idaho to require secret ballot elections for an employer to recognize, certify, or collectively bargain with a representative of employees. The bill mandates that the director of the Department of Labor conduct secret ballot elections to determine employee representatives, and prohibits an employer from recognizing or collectively bargaining with a representative unless the employees have voted in favor of that representative through a secret ballot election. The bill also clarifies that the director, a school district board of trustees, or any other employer cannot conduct an election on matters under federal jurisdiction, and that no election can be held within 12 months of a previous valid election.
