This bill would make several changes to the procedures for handling a decedent's estate when the gross value does not exceed a certain threshold. Specifically, it would exclude real property that was included in a petition to the superior court from the affidavit procedures, change the petition procedures to apply only to real property that was the decedent's primary residence with a gross value not exceeding $750,000 (or the adjusted amount set by the Judicial Council), require notice to be provided to each heir and devisee named in the petition, and specify that "primary residence" is not limited to the decedent's residence at the time of their death.
