This bill amends Section 308 of the Penal Code to create separate fines for firms, corporations, businesses, retailers, or wholesalers who sell or furnish tobacco or related products and paraphernalia to persons under 21 years of age. The first offense would carry a $500 fine, the second offense a $1,000 fine, and any subsequent offenses a $5,000 fine. This is in addition to the existing fines for individuals of $200 for the first offense, $500 for the second offense, and $1,000 for the third offense. The bill also clarifies that these provisions do not apply to the sale of such products to active duty military personnel 18 years of age or older.
