This bill alters the reimbursement levels for drug products that the Maryland Medical Assistance Program is required to establish, and that pharmacy benefits managers (PBMs) that contract with a pharmacy on behalf of a managed care organization are required to reimburse the pharmacy. The bill requires minimum reimbursement levels to be at least equal to the national average drug acquisition cost of the generic product plus the fee-for-service professional dispensing fee. It also expands the definition of "purchaser" for the purposes of regulating PBMs to include certain insurers, nonprofit health service plans, and health maintenance organizations. The bill provides some exceptions to these requirements, such as for pharmacies owned by or affiliated with a PBM, and for mail order pharmacies.
