This bill addresses state agency review of federal regulations. It requires each state agency in Utah to identify any federal regulations that were issued by a federal agency to implement a federal statute and received Chevron deference (a legal doctrine where courts defer to a federal agency's reasonable interpretation of an ambiguous statute). The state attorney general may file suit to challenge any such federal regulations if the U.S. Supreme Court limits or holds that courts cannot give Chevron deference to federal agencies. The attorney general must report any such lawsuits to the Federalism Commission. The bill takes effect on May 1, 2024.
