This bill revises the crime of unlawful possession of marijuana in Alabama based on the amount of ounces possessed. Possession of one or more ounces of marijuana is now a crime classified as a Class D felony, punishable by a fine, on the third or subsequent conviction within five years. Possession of less than one ounce is a violation punishable only by a fine. The bill also allows for the expungement of records related to charges, findings, or convictions under these marijuana possession laws if the person has not been convicted of any other felony, misdemeanor, or violation (excluding minor traffic violations) in the previous five years.
