This bill provides a line of duty disability presumption for any condition of impairment of health caused by diseases of the lung, resulting in total or partial disability or death of certain deputy sheriff members of a retirement system in certain cities. Specifically, it establishes that such a condition shall be presumptive evidence that it was incurred in the performance and discharge of duty, unless the contrary is proved by competent evidence. The bill also provides that a deputy sheriff member retiring under this provision shall receive a pension equal to three-fourths of their final average salary, and a retired member who would have been able to retire under this provision shall have their pension recalculated accordingly. This bill aims to support deputy sheriffs in certain cities who develop lung diseases in the line of duty.
