This bill criminalizes the fentanyl-related endangerment of a child or vulnerable adult. It prohibits knowingly engaging in the manufacturing or possession of fentanyl in the presence of a child or vulnerable adult, or causing them to inhale, be exposed to, or ingest fentanyl. The bill provides criminal penalties of up to 5 years in prison and a $10,000 fine. It also allows peace officers to take a child into protective custody and requires them to report suspected maltreatment of a vulnerable adult in these circumstances. The bill proposes to add these provisions as a new section to the Minnesota Statutes, Chapter 152, effective August 1, 2024.
