This bill amends the existing law on the criminal offense of unlawful use of a laser pointer. It expands the definition of "laser pointer" to include any portable device that emits a visible beam of laser light that may be directed at an individual. Additionally, it creates a new offense for directing a beam of laser light from a laser pointer at an aircraft or the occupants of an aircraft, which is a class B misdemeanor, or a class A misdemeanor if the actor has a prior conviction, or a third-degree felony if the conduct causes an aircraft to crash or perform an emergency landing. The bill also clarifies that the existing offenses for directing a laser pointer at a moving motor vehicle or a law enforcement officer remain in place, with the latter subject to an affirmative defense under certain circumstances. The bill takes effect on May 1, 2024.
