This bill directs the New Jersey Department of Environmental Protection (DEP) to develop guidelines within 180 days of enactment to encourage State and local government agencies to purchase goods made with recycled materials, including compost. The guidelines can be based on or incorporate recommendations from the United States Environmental Protection Agency's Consolidated Recovered Materials Advisory Notice. The DEP must publish these guidelines on its website, and state and local procurement agencies must attempt to reflect these guidelines in new product specifications when practical and feasible. The bill includes several exceptions to this requirement, such as existing contractual obligations, previously advertised bid packages, and contract amendments where following the guidelines would cause significant delays or cost increases. Agencies are not required to follow the guidelines if doing so would substantially increase the cost of a contract. The act takes effect immediately upon enactment, aiming to promote recycling and the use of recycled materials in government purchasing.
