This bill would add kratom products to the Sherman Food, Drug, and Cosmetic Law, requiring processors of kratom products to register with the California Department of Public Health (CDPH) and pay annual fees. The bill would set limits on the alkaloid content and labeling requirements for kratom products, prohibit the sale of kratom leaf and certain kratom products, and authorize CDPH to take enforcement actions. The bill would allow existing kratom processors to continue operating until April 1, 2025, without authorization, as long as they comply with the new requirements. The bill would also exempt the calculation of registration fees from the Administrative Procedure Act.
