This bill prohibits the issuance of a building permit for the construction or substantial alteration of an in-ground swimming pool unless a barrier that complies with the requirements of Section 305 of the International Swimming Pool and Spa Code portion of the State Building Code is installed or included in the plan. It also requires existing in-ground swimming pools without such a barrier to have one installed by July 1, 2025. The bill preempts the State Building Code's exception that allows for the installation of a powered safety cover or retractable cover in lieu of a barrier. The provisions of this bill will be enforced as part of the State Building Code, and the Department of Administrative Services is required to inform local building officials and post the requirements on its website.
