This bill would require developers and deployers of automated decision systems to perform impact assessments on those systems before deployment and annually thereafter. The assessments must analyze the risk of algorithmic discrimination and describe steps taken to mitigate that risk. The bill would prohibit the use or availability of automated decision systems that have a reasonable risk of algorithmic discrimination until the risk is mitigated. It would also require deployers to notify individuals subjected to consequential decisions made by the systems and provide them an opportunity to request alternative selection processes or accommodations. The Civil Rights Department would be authorized to investigate potential violations and bring civil actions against deployers or developers, with the potential for civil penalties in cases involving algorithmic discrimination.
