This bill requires attorneys to execute and maintain an affidavit for 7 years certifying whether a generative artificial intelligence (AI) program was used in drafting any document filed in a state or federal court in California. Attorneys must file the affidavit with the court upon request. The bill defines "generative AI" as a machine-based system that can make predictions, recommendations, or decisions influencing real or virtual environments using machine- and human-based inputs. The bill also expresses the Legislature's intent to enact legislation requiring legal professionals to disclose to the court whether they have used AI or machine learning to prepare any documents filed in California courts.
