This bill amends Idaho law to establish an electronic smoking device directory. The key provisions are: 1. Manufacturers of electronic smoking devices sold in Idaho must annually certify that their products have received FDA marketing authorization or were on the market as of August 2016 and have a pending FDA application. Manufacturers must pay fees for each certified product. 2. The state Department must maintain a publicly available directory of certified electronic smoking devices by October 2024 and notify retailers, distributors, and wholesalers of changes to the directory. 3. After the directory is published, retailers, distributors, and wholesalers have 60 days to remove non-directory products from their inventory. Thereafter, sale of non-directory products is prohibited and subject to penalties. 4. The Department must conduct at least two annual unannounced compliance checks of retailers, distributors, and wholesalers, and publish the results. 5. The bill imposes various penalties, including fines and permit suspensions, for violations of the directory requirement.
