Bill Summary
An act to amend Sections 290 and 647 of the Penal Code, relating to crimes.
AI Summary
This bill amends existing law to make the offense of soliciting a minor punishable only if the defendant is 18 years of age or older at the time of the offense. If the solicited minor is under 16 years of age or the solicited person is under 18 and a victim of human trafficking, the offense is punishable by either up to 1 year in county jail and a fine, or by imprisonment. A second or subsequent offense under these conditions is punishable as a felony. The bill also requires a person 18 or older who is convicted of soliciting a minor and has a prior solicitation conviction to register as a sex offender for 10 years if the person was more than 10 years older than the solicited minor. The bill incorporates changes proposed by other bills and provides that no reimbursement is required for the state-mandated local program.
