This bill amends Chapter 94C of the General Laws to require health plans and pharmacy benefit managers to provide cost, benefit, and coverage data to patients, their prescribing practitioners, or their personal representatives upon request. The data must be current as of one business day, provided in real-time in the clinical setting, and in the format requested, using established industry standards. The bill prohibits health plans and pharmacy benefit managers from restricting, prohibiting, or hindering prescribers from communicating or sharing the provided data, as well as additional information on lower-cost or clinically-appropriate alternatives, payment or cost-sharing information, or from prescribing such alternatives. It also requires health plans and pharmacy benefit managers to treat an enrollee's identified personal representative as the enrollee for the purposes of this section.
