This bill adds a new section to Idaho's criminal code to create the crime of "organized retail theft." It defines organized retail theft as occurring when two or more people, in concert, commit a theft of merchandise worth over $1,500 within a 90-day period, or a theft of merchandise worth over $750 with the intent to resell it, or commit two or more thefts within 30 days involving 10 or more items. It establishes penalties of up to 15 years in prison and a $20,000 fine, with enhanced penalties if the person committing the organized retail theft is a manager who recruits or directs others to carry out the thefts. The bill also defines relevant terms like "merchandise" and "mercantile establishment."
