This bill restricts the use of polystyrene foam disposable food service ware by restaurants in Alaska, with some exceptions. It prohibits restaurants from providing prepared food in polystyrene foam containers, and requires them to use biodegradable or compostable disposable food service ware instead, unless they can demonstrate that an affordable alternative is not available. The state is also prohibited from using or purchasing polystyrene foam disposable food service ware. The bill provides an exemption process for restaurants facing undue hardship, and it also exempts prepared food packaged outside the state, polystyrene foam coolers and ice chests intended for reuse, and areas affected by a disaster emergency. The bill will take effect on January 1, 2025.
