This bill amends Georgia's property laws to prohibit condominium associations, property owners' associations, and homeowners' associations from preventing property owners from installing solar energy devices on their roofs or roof structures, even if those are common elements for which the association is responsible for maintenance. The bill defines "solar energy device" and specifies that associations cannot require permits or fees for the installation, maintenance, or use of these devices. However, if roof maintenance becomes necessary after a solar energy device is installed, the property owner who installed the device must bear the costs of removal and reinstallation. The provisions of this bill apply to instruments and rules adopted on or after January 1, 2025.
