This bill prohibits the use of noncompete agreements (also known as covenants not to compete) and exclusivity agreements, unless certain requirements are met. For noncompete agreements, the key requirements include limiting the duration to no more than one year (with a possible two-year exception), protecting a legitimate business interest, and ensuring the worker is an exempt employee with a high enough hourly wage. For exclusivity agreements, the key requirements are that the worker must be an exempt employee or independent contractor with a high enough hourly wage, or the additional employment must pose safety risks or substantially interfere with the worker's schedule. The bill also provides workers the right to bring civil actions against violations, and empowers the Attorney General to investigate and enforce these provisions.
