This bill expands the prior authorization mental health carve out, which exempts certain mental health medications from prior authorization requirements. Specifically, the bill removes the requirement for prior authorization or other utilization management controls for any FDA-approved medication indicated for the treatment of a mental disorder or condition that results in a serious functional impairment. This applies to the state's Medicaid program and any multistate preferred drug list or supplemental drug rebate program. The bill also provides definitions for "utilization management controls" and specifies that prior authorization must be automatically granted for 60 days when a generic equivalent becomes available for a brand name mental health medication that was previously prescribed.
