This bill, known as Alex DeCroce's Law, enhances crime victims' rights under the "Crime Victim's Bill of Rights" by expanding protections against intimidation, harassment, or abuse from any person, including the defendant or those acting on their behalf, due to the victim's involvement in the criminal justice process. It also clarifies that victims are entitled to medical assistance reasonably related to the incident and to be informed in a timely manner if their presence in court is not needed or if a proceeding is adjourned or canceled. The bill further strengthens victims' rights by allowing them to make a written statement about the crime's impact to the prosecuting agency for consideration before formal charges are filed or plea agreements are made, and to consult with the prosecuting authority prior to the conclusion of plea negotiations, with the prosecutor advising the court of the victim's position. In homicide cases, victims' survivors are granted the right to display a photograph of the victim to the sentencing court and to wear a button with the victim's picture during judicial proceedings, provided it doesn't jeopardize the defendant's right to a fair trial. Additionally, crime victims will no longer be required to pay for the costs associated with the imprisonment or commitment of their victimizer, and victims gain enhanced standing to be present at judicial proceedings, enforce their rights, and receive court decisions on motions filed to uphold these rights.
