This bill amends Minnesota Statutes to permit clients of civil legal services and volunteer attorneys to proceed without payment of court fees without additional findings by the court. Under the current law, courts can authorize the commencement or defense of civil actions without prepayment of fees for those who are financially unable to pay, but the court must make a finding that the action is not frivolous. The bill adds a new provision that allows a person represented by a civil legal services program or volunteer attorney program based on indigency to proceed without payment of fees without the need for additional findings by the court, as long as the attorney submits an affidavit or makes an oral attestation stating that legal services are being provided to the client.
