This bill modifies existing law to allow partnerships and joint ventures to bid on specific types of public works and prevailing wage contracts, with important conditions: each partner or joint venture participant must be independently registered with the Department of Labor and Workforce Development, obtain a Public Works Contractor Registration certificate, and designate a primary contract manager. The bill specifically applies to heavy infrastructure projects, which include roads, bridges, tunnels, railways, airports, seaports, transit systems, water and wastewater treatment facilities, and environmental remediation efforts. Importantly, if any party to the partnership or joint venture fails to perform or comply with the contract, all parties will be held jointly and severally liable, which means they can be collectively responsible for penalties, potentially including contract cancellation. This change aims to provide more flexibility for contractors while maintaining accountability and ensuring that all participants meet registration and compliance standards for public works projects.
