This bill amends and adds to existing Idaho law to revise provisions regarding certain time requirements, penalties and damages, and charges for care of stray or "estray" livestock. Key changes include: 1) Expanding the definition of "estray" to include trespassing livestock whose owner is known but permits them to roam without permission. 2) Reducing the time requirement for the sheriff or brand inspector to notify the owner of stray livestock from 5 days to 3 days before seizing and selling the livestock. 3) Increasing the maximum daily rate that can be charged for feeding and caring for stray livestock from $2 to $5 per head for cattle and horses, and from $0.75 to $2 per head for other animals. 4) Establishing penalties for willfully allowing livestock to stray, including fines up to $750 for repeat offenses within 5 years, as well as allowing the damaged party to seek compensation for any damages caused by the stray livestock at a rate of up to $10 per head per day for cattle/horses and $4 per head per day for other animals. The bill also declares an emergency, allowing it to take effect immediately upon passage and approval.
