This bill, also known as the "John Hubbard Move Over Act," amends the existing Alabama Move Over Act. The key provisions of this bill are: 1. It expands the requirement to move over or slow down when approaching authorized law enforcement vehicles, emergency vehicles, wreckers, utility service vehicles, maintenance/construction/survey vehicles, and garbage/trash/recycling collection vehicles that are parked or actively performing their duties on the roadside. Drivers must either vacate the lane closest to these vehicles or slow down by at least 15 mph below the posted speed limit. 2. It increases the fines for violations, with a minimum fine of $200 for the first offense, $250 for the second offense, and $300 for the third or subsequent offense, along with a driver's license suspension of at least 90 days for the third or subsequent offense. 3. It adds enhanced penalties if the violation is the proximate cause of a collision, including misdemeanor charges for physical injury, felony charges for serious physical injury or death, and the requirement to pay restitution to victims. 4. It requires the Alabama State Law Enforcement Agency to conduct an educational campaign to inform the public about the Move Over Act and assist drivers in determining the appropriate response. The bill becomes effective on October 1, 2024.
