This bill, the Time Off to Vote Act, requires employers to provide a minimum of 2 consecutive hours of paid leave to employees on the day of any federal election, so that they can vote, return a mailed ballot in person, or engage in other voting-related activities. Employers may specify the hours during which the leave can be taken, including by requiring the use of early voting periods if applicable under state law. The bill prohibits employers from interfering with or retaliating against employees for taking this leave, and gives the Department of Labor investigative and enforcement authority, including the ability to impose civil penalties of up to $10,000 per violation. The bill does not supersede any state or local laws that provide employees with greater voting-related leave benefits.
